By using AyeHigh, you are agreeing to the Terms of Service ('Terms') that govern its use, unless we explicitly state that separate terms apply. These Terms provide important information about the AyeHigh Service and define the rights and responsibilities of its users.

The AyeHigh Platform is a product offered by AYE Inc. As such, by using this platform, you are entering into an agreement with AYE Inc. Please note that the AYE Terms of Service do not apply to the AyeHigh Platform.

By accessing this Web Application, we assume you accept these terms and conditions. Do not continue to use ayehigh.com if you do not agree to take all of the terms and conditions stated on this page. If you do not agree with (or cannot comply with) Agreements, then you may not use the Service, but please let us know by contacting us so we can try to find a solution. These Terms apply to all visitors, users, and others who wish to access or use Service.

Eligibility

To use or create an account on the Website, you must be at least 13 years old. By agreeing to this Agreement and using the Website and Services, you confirm that you meet this age requirement. If you create an account, it is your responsibility to keep it secure and monitor all activity that occurs under it.

Account

To use features of AyeHigh, you must create a user account. You agree to provide accurate and complete information when creating your account and to keep your account information up-to-date. You are responsible for maintaining the confidentiality of your account login information and for any activity that occurs under your account.

Providing false contact information is not recommended, as it may result in the problems related to security of your account. Please notify us immediately if you notice any unauthorized use or security breaches on your account.

We are not liable for any damages caused by your actions or omissions. If we find that you have violated any terms of this Agreement or your conduct is likely to damage our reputation, we may suspend, disable, or delete your account (or part of it) without notice. To prevent further registration attempts, we may block your email address and Internet protocol address.

Prohibited Uses

You may use Service only for lawful purposes and under Terms. AyeHigh may terminate or suspend your account at any time and for any reason whatsoever and without limitation, including but not limited to a breach of Terms. You may also terminate your account at any time. Upon termination, all provisions of these terms that by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability. You agree not to use Service: In any way that violates any applicable national or international law or regulation. To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of Service, or which, as determined by us, may harm or offend Company or users of Service or expose them to liability. Use Service in any manner that could disable, overburden, damage, or impair Service or interfere with any other party’s use of Service, including their ability to engage in real-time activities through Service. Use any robot, spider, or other automatic devices, process, or means to access Service for any purpose, including monitoring or copying any of the material on Service. Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful. Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of Service. Attack Service via a denial-of-service attack or a distributed denial-of-service attack. Take any action that may damage or falsify the Company rating.

Accuracy of Information and AI Outputs

Our platform leverages third-party LLMs along with our Logic. While we aspire to provide the most accurate results possible, please understand that these outputs may not always be 100% accurate or reliable as Generative AI is a non deterministic machine (running it multiple times even with the same input may result in different behavior each time it is run). We encourage users to critically review and verify the information provided by our AI solutions before utilizing this information for decision-making or other consequential actions. The platform should be used as a guide rather than a sole source of information.

Data & Security

At AyeHigh, we are committed to providing our users with a seamless and secure online experience. To help us achieve this goal, we use cookies and collect information about the user's device, IP address, through the user agent for various services, including but not limited to, analytics and security. Cookies are small files that are stored on your device when you visit our website. They help us to remember your preferences, customize your experience, and provide us with information about how you interact with our platform for better user experience and security. By using AyeHigh, you consent to our use of cookies in accordance with our Terms of Use.

We take the privacy and security of our users seriously, and we will never collect or use any information in a way that is not in accordance with our Terms of Use. We all possible best measures to protect user data and prevent unauthorized access. However, we cannot guarantee the security of your information. User Responsibilities

As a user, you are responsible for your interactions within the platform. Any violation of these terms could lead to suspension or permanent ban from the platform. These services are provided by company on an “as is” and “as available” basis. Company makes no representations or warranties of any kind, express or implied, as to the operation of their services, or the information, content, or materials included therein. You expressly agree that your use of these services, and any services or items obtained from us is at your sole risk. Neither the company nor any of its employees makes any warranty or representation regarding the completeness, security, dependability, quality, accuracy, or availability of the services.

Referral Terms

As a user, you can refer others to help onboard new users. Upon meeting the referral terms, certain rewards are provided to the user who referred all the other users. Referral credits can change.

Payment and Credits

These Payment and Credits Terms & Conditions ("Payment Terms") apply to your purchase and use of Credits on AyeHigh. By purchasing and using Credits, you agree to these Payment Terms.

Credits can be purchased on our platform through various payment methods offered, including but not limited to credit card payments via Stripe. Once purchased, the amount of Credits will reflect in your AyeHigh account. These Credits are non-refundable and cannot be exchanged for cash or any other forms of payment unless otherwise specified in these terms.

Credits can be used only within the AyeHigh platform to access AI solutions and other features that require Credits. Credits have no monetary value and cannot be used outside of the platform or exchanged for goods or services not offered by AyeHigh.

The price and availability of Credits can change without prior notice, though we would inform existing users via Email just for information purpose. However, such changes will not affect Credits that have already been purchased. All prices listed on the platform are inclusive of any applicable taxes unless otherwise stated.

Unless otherwise stated, Credits have no expiration date and remain in your account until used.

In case of Credits deducted for any Solutions which didn't function due to technical error or issue, those Credits will be refunded back to your account. In cases if its not refunded automatically, please contact our support team viaContact Pageimmediately. We will investigate the matter, and if validated, credits will be refunded to your account.

Purchased Credits are non-refundable except as required by law with proper ruling or as otherwise explicitly stated in these terms. In cases of failed, unauthorized or fraudulent purchase transactions, please contact our support team viaContact Pageimmediately. We will investigate the matter, and if validated, a refund or chargeback may be issued.

All payment processing on AyeHigh is done via Stripe Third Party Payment Services as of now, which can change if required. By making a payment, you agree to abide by Stripe's terms and conditions and understand that AyeHigh is not liable for any issues related to the processing of your payment by Stripe.

We take all reasonable precautions to protect your payment details and personal information. However, in the event of unauthorized access or breaches, we are not liable for any losses related to such unauthorized access or breaches unless such breach is due to our negligence.

AyeHigh reserves the right to change or modify these Payment Terms at any time. If we make changes, we will provide notice on our platform or via email. Your continued use of the platform after such changes means you accept the updated Payment Terms.
